Divorce & Legal Separation
Everybody knows what a divorce is, but we can help navigate some of the trickier nuances and make sure that things go as smoothly as possible in the sense of asset division.
We can help to fairly determine and execute plans for who gets what, and explain what to expect in terms of asset division, asset sale, and asset preservation. We can also help to determine how to deal with property that was acquired prior to the marriage.
Custody
When children of a divorced/ separated couple are under the age of 18, there may be disputes over who they get to live with or how certain decisions are made.
We can help navigate disputes that arise related to these issues, and determine fair custody agreements, always with the child’s/children’s best interest in mind.
Child Support
Child support is largely set by charts that are created by the legislature. This means that these charts do not get to be deviated from, except in certain situations.
We can help figure out a way to deviate from them if you are not able to meet the requirements for child support. We can also work to overcome deviation requests, if the situation calls for it. We are very familiar with litigating financial issues and making sure that income is properly documented, especially if the other side is trying to hide or intentionally reduce income to avoid paying.
Restraining Orders
These would apply when actions are taken in a family law case to prevent someone from disposing of or hiding assets.
This can include freezing bank accounts, requiring accountability (accounting for missing assets, forcing disclosure of things that were hidden, or allowing monitoring of an account by the opposing side or the court), or otherwise ordering preservation of assets pending trial.
Judgment Enforcement
Sometimes upon completion of a divorce case, custody battle or child support fight, the other side refuses to comply with their end of the final agreement (by withholding funds, not complying with the terms of a custody arrangement, violating a restraining order, etc.).
There are other ways, such as contempt motions, to hold them accountable and make sure that whatever the judge ordered happens. This process is called “Contempt” or “Judgement Enforcement”.
